Terms of Service

These terms govern Portfloor's card creation, storage, generation and sharing services. By agreeing to these terms, you enter an agreement with the operator of Portfloor ("we", "us"). Questions: support@portfloor.com.
1. Your account
You must have legal capacity to enter this agreement, or permission and supervision from a parent or legal guardian where permitted by law. Provide accurate account information, protect access to your account and report unauthorized use. Do not impersonate others, bypass restrictions or create accounts to exploit free trials.
2. Your content and rights
You are responsible for the prompts, images, text and other material you submit, and for how you use, publish or distribute the results. You confirm that you have the rights, permissions or other lawful basis necessary for those activities, including rights relating to copyright, trademarks, privacy and people's likenesses. Owning a physical product does not automatically give you rights to someone else's photograph or artwork.
We do not claim ownership of your original uploads. Any rights you have in generated images remain subject to applicable law and third-party rights. A subscription, successful generation or download does not provide a license from a brand, character owner or person depicted.
3. Permission to operate the service
You grant us a non-exclusive, worldwide, royalty-free permission to store, reproduce, process and display your content as needed to provide and secure the service. We may authorize infrastructure and generation providers to process it for those purposes. Public cards may appear on Explore and shared pages. This permission does not authorize us to publish cards marked private.
Free cards are created publicly; Plus offers privacy controls. Existing private cards remain private. Removing a card from public view ends future public display by us, but cannot recall copies others already made. Limited retention may be necessary for backups, security or legal obligations. This clause does not grant a separate right to use your private content in advertising.
4. AI images and examples
Images may be AI-generated and may differ from actual products, characters or people. Names, specifications and user-entered values may be inaccurate; values are not live prices, appraisals or investment advice. We do not guarantee unique results, exact product fidelity, copyright protection or clearance for a particular use. Review results before relying on or publishing them.
Third-party names and depictions do not indicate sponsorship, approval or an official partnership. Operator-created examples remain our responsibility; these terms do not reclassify them as user uploads.
5. Acceptable use
Do not use Portfloor for rights infringement, fraud, deceptive endorsements, unlawful impersonation, harassment, non-consensual intimate imagery, child exploitation or other unlawful content. Do not evade safeguards, abuse generation allowances, interfere with service security or distribute malware. We may refuse generation, restrict sharing or suspend access where reasonably necessary to address abuse, rights complaints or legal requirements.
6. Rights complaints and review
Send copyright, trademark or privacy complaints to support@portfloor.com. Identify the protected work or right, the exact card or page URL, the reason for your complaint, your contact details and your authority to act. For a copyright notice, include your physical or electronic signature, a good-faith statement that the use is not authorized by the rights holder, its agent or law, and a statement under penalty of perjury that the information is accurate and you are authorized to act.
We review sufficiently detailed complaints and restrict or remove content when warranted. We may ask for evidence and notify the uploader, subject to privacy and legal requirements. To challenge a removal, email the same address with the URL and supporting explanation. Applicable legal notice and counter-notice procedures take precedence. We terminate repeat infringers in appropriate circumstances. Knowingly false complaints are prohibited. We may also act on infringements we become aware of without a complaint.
7. Plans and billing
Features and usage allowances depend on your plan. AI access is subject to usage limits and is not unlimited. Paid subscriptions, when available, renew as disclosed at checkout until canceled. Manage cancellation through the billing portal or contact support. Prices, taxes, renewal timing and applicable refund terms are presented at checkout. Nothing here removes statutory cancellation or refund rights. Test-mode checkouts are not real purchases.
8. Claims arising from misuse
To the extent permitted by law, you agree to reimburse Portfloor for reasonable losses and legal costs arising from third-party claims caused by your unlawful content, infringement of third-party rights or material breach of these terms. We will provide reasonable notice and an opportunity to participate in the defense. No settlement may impose an admission or non-monetary obligation on you without your consent. This obligation does not cover losses caused by our own misconduct or matters for which liability cannot lawfully be transferred.
9. Service and liability limits
To the extent permitted by law, the service is provided as available, without additional guarantees of uninterrupted operation, accuracy or fitness for a particular purpose. We exclude indirect and consequential losses to the extent lawful. Our total liability relating to the service is limited to the greater of US$100 or the fees you paid us in the twelve months preceding the event giving rise to the claim.
These limits do not exclude fraud, willful misconduct, gross negligence, liability for death or personal injury where exclusion is prohibited, or any mandatory consumer rights or other liability that cannot legally be limited. Where local law requires greater protection, that protection applies.
10. Changes and contact
We may update these terms and will provide notice of material changes before they take effect, except where urgent legal or security reasons require otherwise. Where required, we will seek renewed agreement. Changes do not retroactively remove accrued rights. An unenforceable provision does not invalidate the remaining terms. Contact support to resolve concerns; nothing here prevents you from using courts or remedies available under mandatory law.
